Terms and Conditions

Welcome to Framewalk. These Terms and Conditions (“Terms”) govern your access to and use of the Framewalk website, mobile apps, and related services (the “Service”) operated by nheek (“we”, “us”). Please read them carefully.

1. Acceptance

By creating an account, logging in, or otherwise using the Service, you agree to these Terms and to our Privacy Policy and GDPR information where applicable. If you do not agree, do not use the Service.

2. Eligibility and account security

  • You must be at least 13 years old (or the minimum age required in your jurisdiction to consent to data processing, if higher).
  • You may sign in with email and password or, on supported devices, Sign in with Apple. Apple’s terms and privacy policy apply to that sign-in flow.
  • You are responsible for maintaining the confidentiality of your credentials and for activity under your account.
  • You must provide accurate registration information and keep it reasonably up to date.

3. The Service

Framewalk is a photo-hunt product: you get a daily (or custom) prompt, open a hunt (walk draft), capture frames, optionally record a GPS trail and map settings, then keep the walk as a post with visibility you choose (public, followers, or friends—friends means mutual follow). Themes can be any photographable subject (indoor or outdoor). Features may include feeds, Explore, follows, likes, reposts (reshare into followers’ feeds while the original visibility still applies), notifications, theme walks (“use this theme” / people who framed a prompt), parked and discarded shelves, plans that raise frame and open-walk limits, and other capabilities we add or change over time.

Kept walks require an even frame count at or above the product minimum (currently 4), capped by your plan. Discarded hunts are recoverable only for the retention window of your plan, then permanently deleted.

We may modify, suspend, or discontinue parts of the Service with reasonable notice where practicable.

4. Acceptable use

You agree not to:

  • break the law or infringe others’ rights (including copyright and privacy);
  • upload unlawful, abusive, violent, hateful, or sexually exploitative content, especially involving minors;
  • invent prompts that request or encourage illegal or harmful activity (we may block or moderate prompts);
  • photograph or post people without a lawful basis or their permission where required;
  • enable location trails or share maps in ways that reveal others’ whereabouts without permission;
  • harass, threaten, or impersonate others;
  • attempt to hack, scrape, overload, or reverse engineer the Service except where applicable law forbids this restriction;
  • circumvent security, payment, or plan limits;
  • upload malware or misuse storage in a way that harms others or the platform.

We may remove content, restrict features, or suspend or terminate accounts that violate these rules or create risk for users or the Service.

You can report walks or profiles and block other users in the app. Blocking hides their walks from you (and yours from them) and ends follow relationships both ways. You can unblock anytime in Settings → Blocked users. Reports may receive automated triage (when AI is configured) before a human review; contact [email protected] if you need further help.

Prompt safety: User-written prompts are moderated for safety. Repeated unsafe prompt attempts can lead to warnings, a last warning, and then an account ban. A banned account can sign in only to submit an appeal. You may have one open appeal per ban; if we reject the appeal, that decision is final for that ban. We may also suspend or ban accounts for Terms violations outside the prompt-safety ladder.

5. User content

You retain rights to photos and text you submit. You grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, and transmit your content only as needed to operate the Service (for example showing your hunts to you, displaying a public or followers/friends post to eligible viewers, generating/moderating prompts, matching similar themes via embeddings when configured, or producing an optional machine translation when a viewer taps Translate).

Translations of captions and prompts are generated by third-party AI when that feature is enabled. They may be inaccurate or incomplete. Do not rely on translations as authoritative. We may cache translations to serve the same request efficiently.

Theme similarity: When AI is configured, we may embed prompt text and compare it to other themes (including across languages) to suggest existing themes or discourage near-duplicates. Similarity matching is imperfect; you may still see suggestions that are not exact matches.

You represent that you have the rights to the content you upload and that it does not violate law or third-party rights.

6. Purchases and subscriptions

  • Plans: Free, Frame+, and Frame Exclusive (and any successors) set frames-per-walk, open-walk limits, discard retention, and monthly custom-prompt allowances as described in-product. Paid subscriptions renew monthly. Prices are shown in the app and in the app store at purchase time (currency depends on your store region). Only monthly subscriptions are offered.
  • Billing: Mobile purchases are processed by Apple or Google. We receive subscription status, not your full payment card details.
  • Apple EULA: On iOS, paid plans are also governed by [Apple’s Standard Licensed Application End User License Agreement](https://www.apple.com/legal/internet-services/itunes/dev/stdeula/).
  • Refunds: Unless mandatory consumer rights apply in your country, refunds follow the refund rules of the store that processed the payment.
  • Restore: You can restore eligible purchases on a device signed into the same store account.

7. Third-party services

The Service may rely on third-party infrastructure (hosting, object storage, payments, push delivery, Sign in with Apple, map tile providers, and optional AI providers for prompts, moderation, theme similarity, and on-demand content translation). Their terms and privacy policies apply to your use of those services where relevant.

8. Disclaimer of warranties

The Service is provided “as is” and “as available” to the fullest extent permitted by law. We disclaim implied warranties such as merchantability, fitness for a particular purpose, and non-infringement where allowed. Prompt ideas, AI outputs, and machine translations are not guarantees of safety, legality, accuracy, or fitness for any particular activity—use common sense when photographing and when reading translated text.

9. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the Service.

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or other liability that cannot be limited under applicable law.

10. Indemnity

To the extent permitted by law, you agree to indemnify and hold us harmless from claims arising out of your content, your use of the Service, or your breach of these Terms.

11. Governing law and disputes

These Terms are governed by applicable law in your contract with us, without regard to conflict-of-law rules that would require another jurisdiction’s laws. Mandatory consumer protections in your country of residence remain unaffected where required by law.

12. Changes

We may update these Terms from time to time. We will post the updated Terms and the “Last updated” date. If changes are material, we will provide additional notice where required by law. Continued use after the effective date constitutes acceptance of the updated Terms where permitted.
